What should an Amazon medical device appeal contain?
An Amazon medical device appeal should answer the exact Seller Central request and show that every document belongs to the exact ASIN. Start with the case or application ID, identify the product and manufacturer, select the correct FDA pathway, and submit only the evidence that supports that pathway.
Amazon’s public Health & Personal Care guide says an application prompts the supporting documents or other steps required. It lists an FDA 510(k) clearance number among the documents a medical-device seller might need, but FDA also recognizes 510(k)-exempt devices and other premarket pathways. The current notice—not a generic checklist—controls your submission.
JurisdictionUnited StatesFederal scope
Branch A
510(k)-cleared device
Match the ASIN to the exact K number, device name, applicant or manufacturer, product code and intended use.
Branch B
510(k)-exempt device
Identify the FDA product code, classification regulation, exemption and the limitations you reviewed.
Branch C
PMA, De Novo or HDE
Use the FDA record for the actual pathway. Do not convert another authorization into a 510(k) claim.
Branch D
Not a medical device
Explain the intended use and claims, document the classification search, and obtain FDA input when uncertainty remains.
Freeze the case before you collect documents
Do not begin with a folder of certificates. Begin with the message Amazon is asking you to answer. Save the notice as a PDF or screenshot and transcribe its operative details into a working note:
- Record the case or application ID and the ASIN. Keep each submission tied to one review record.
- Copy the exact requested action. Separate a request for a 510(k) number from a request for FDA registration, product images, labeling or another document.
- Capture the reason or error text. Do not paraphrase it until the evidence plan is complete.
- Save the listing as reviewed. Preserve the title, bullets, images, model, brand, GTIN and intended-use claims.
- Check the application status path. Amazon directs sellers to Catalog → View Selling Applications for the current status.
This is an editorial control, not an Amazon form. It prevents a common production error: preparing a technically valid document that answers a different question or belongs to a different model.
Build one product identity crosswalk
A reviewer should not have to guess how the marketplace listing connects to the FDA record. Create a one-page crosswalk and make every attachment use the same identity.
| Identity field | Marketplace record | FDA or manufacturer record | Check before upload |
|---|---|---|---|
| Product | ASIN, listing title, brand | Proprietary or device name | Same product, not merely a similar device |
| Model | Model, size, variant, GTIN/UPC | Model or catalog identifier where available | Variant is covered by the evidence |
| Responsible firm | Brand owner, seller or supplier | 510(k) applicant, manufacturer, specification developer or listing firm | Relationship is explained and supported |
| Intended use | Claims, bullets, images and instructions | Cleared, classified or exempt intended use | No broader disease or performance claim |
| FDA pathway | Amazon’s requested proof | 510(k), exemption, PMA, De Novo, HDE or non-device basis | Correct pathway named without approval inflation |
| Registration/listing | Any requested establishment or listing evidence | Current releasable FDA record | Not presented as clearance or certification |
Identity gaps are substantive. A K number for the same generic product type is not evidence for your ASIN. When reseller or private-label relationships create different names, explain the relationship and obtain supporting records from the responsible firm.
Choose the correct FDA evidence branch
If the exact device has 510(k) clearance
Use FDA’s releasable 510(k) database to verify the K number, device name, applicant, product code, decision date and decision. Compare the public record and available summary or statement with the product you sell. A 510(k) is cleared, not “FDA approved.”
Attach the evidence requested by the current Amazon case. A concise packet can include the FDA database record, the relevant clearance letter or summary when available, the identity crosswalk, and current label or instructions when they are needed to show product and intended-use alignment.
If the device is 510(k)-exempt
Do not stop at “Class I.” FDA says most Class I and some Class II devices are exempt, subject to the limitations in the applicable classification regulations. Record the product code, regulation number, device class, exemption status and the specific limitations you reviewed. Confirm that the product’s intended use and technological characteristics remain inside that classification.
The detailed decision method is in 510(k) required vs exempt. For the appeal, state the branch in plain language and attach the official classification evidence. Do not fabricate a K number for an exempt device.
If the device uses PMA, De Novo or HDE
Use the FDA database and order for the pathway that actually permits marketing. Most Class III devices follow PMA, while De Novo can classify certain novel low- to moderate-risk devices and HDE applies to a separate humanitarian-device pathway. A marketplace field that says “510(k)” does not change the FDA pathway; explain the discrepancy and provide the exact official record requested or available.
If you believe the product is not a medical device
Explain the product’s intended use, physical operation and public claims. FDA recommends searching the Product Classification Database and similar-device records. If the issue remains uncertain, FDA directs firms to the Division of Industry and Consumer Education and describes a formal 513(g) request as an available route. A bare seller statement that “this is not a device” is weaker than a documented classification analysis.
Stop when the evidence does not cover the product as sold. Do not borrow another manufacturer’s K number, upload a private registration certificate as clearance, or narrow the appeal while leaving broader medical claims in the listing, packaging or instructions.
Keep registration, listing and clearance separate
FDA establishment registration and device listing are different from premarket clearance or approval. FDA states that registration and listing do not denote approval, clearance or authorization, and that it does not issue device registration certificates.
When Amazon requests registration or listing evidence, provide the current record that answers that request. When it requests a 510(k), a registration entry cannot replace a required clearance. FDA also says that a device requiring premarket clearance or approval can be listed only after the relevant submission is cleared or approved.
For an ASIN already restricted around these distinctions, use the Amazon medical-device 510(k) restriction guide before writing the appeal.
Assemble a reviewer-friendly submission
Use filenames and a short index so the reviewer can trace every claim without opening unrelated material. A compact order is:
- Cover note. Name the case/application ID, ASIN, product, requested action and the regulatory branch you are documenting.
- Identity crosswalk. Show the listing-to-FDA relationship for product, model, manufacturer, intended use and pathway.
- Primary FDA record. Provide the exact 510(k), exemption/classification, PMA, De Novo, HDE or other official evidence.
- Registration/listing evidence. Include it only when the notice requests it or it materially establishes the responsible firm and product listing.
- Product evidence. Add current packaging, label and instructions when requested or necessary to demonstrate identity and intended use.
- Relationship evidence. If the seller is not the FDA record holder, explain the reseller, distributor or private-label relationship with manufacturer support.
- Attachment index. Map each filename to one statement in the cover note.
Amazon’s public guide says the application itself prompts required supporting documents and lists several documents sellers might need. Treat any item not shown in your current case as optional support, not a universal Amazon requirement.
Use a short factual cover note
Subject: ASIN [ASIN] · Case/Application [ID] · Medical-device evidence
Requested action: [Copy the Seller Central request exactly.]
Product identity: [Product, brand, model, GTIN/UPC and manufacturer.]
Regulatory branch: [510(k) K-number / exempt product code and regulation / PMA / De Novo / HDE / documented non-device position.]
Evidence map: [Attachment A proves identity; Attachment B proves pathway; Attachment C proves the requested registration or relationship.]
Requested outcome: Please review the attached evidence against the stated requirement for this ASIN.
Do not promise that the packet guarantees reinstatement. Amazon says its review time varies with product type and risk, completeness of documentation and regulatory complexity; it does not publish a fixed timetable on the public guide used here.
Run the final consistency screen
- One ASIN and one case. Remove documents for unrelated models or prior applications.
- One regulatory branch. Do not describe the same device as both 510(k)-cleared and exempt.
- Names and models align. Explain every difference rather than hoping the reviewer infers it.
- Claims stay within the evidence. Check listing copy, packaging, images and instructions together.
- Official records are current and readable. Use direct FDA records, not a vendor-created “FDA certificate.”
- Every attachment answers a sentence. Delete duplicate or decorative material.
- The current notice controls. Recheck the Seller Central application immediately before upload.
If a responsible firm needs to correct a regulatory record or the product genuinely lacks the requested pathway, an appeal cannot manufacture that evidence. Compare the scope of 510(k) regulatory services only after the free classification and identity checks show a real gap.
Frequently asked questions
Does every Amazon medical device appeal need a 510(k)?
No. Amazon may request a 510(k) number, but FDA says most Class I and some Class II devices are exempt, while other devices may use PMA, De Novo or HDE pathways. The exact product classification and current Amazon notice control.
Can I use the manufacturer’s 510(k) number?
Only when the clearance actually covers the device you sell and the relationship can be demonstrated. Match the device name, model, intended use, applicant or manufacturer and product code. Do not use a K number from a merely similar product.
Is an FDA registration certificate enough for Amazon?
Not as proof of clearance. FDA says it does not issue device registration certificates and that establishment registration and device listing do not denote approval, clearance or authorization.
What if the device is 510(k)-exempt?
Provide the exact FDA product code, classification regulation, class and exemption status, plus a reasoned check of the applicable exemption limitations. Do not invent a K number.
How long does an Amazon medical device appeal take?
Amazon’s public guide does not give a fixed review time. It says timing varies with product type and risk classification, document completeness and regulatory complexity. Check the current application status in Seller Central.
