Pending vs Registered Trademark for Walmart

Pending vs registered trademark for Walmart: short answer

Pending vs registered trademark for Walmart is no longer a simple eligibility split. Walmart announced on June 5, 2026 that a brand owner with a pending USPTO application can register a brand in Walmart Brand Portal without waiting for final trademark approval. Walmart still reviews the submission.

JurisdictionUnited StatesFederal scope

A pending application may now be enough for Walmart’s Brand Portal workflow, but it is not a federal trademark registration. A pending application can still face an office action, opposition, abandonment, or refusal. A registered mark has completed the USPTO registration process and carries benefits that a pending application does not.

Documentation conflict: Walmart’s June 5, 2026 release note permits pending applications, while older Walmart Brand Portal pages still say an active USPTO registration is required. The release note is newer. Check the current Brand Portal form before submitting because Walmart has not yet aligned every public page.

What Walmart changed on June 5, 2026

Walmart’s release note says that a seller with a pending USPTO trademark application can register a brand in Brand Portal without waiting for final trademark approval. It adds the condition “once reviewed.” That language supports three conclusions:

  • A pending USPTO application is now an accepted starting status for the Brand Portal enrollment flow.
  • Submission is not automatic approval; Walmart still reviews the brand.
  • Brand Portal enrollment does not change the USPTO application or guarantee that it will register.

Walmart’s older Brand Portal overview, last updated October 14, 2025, says an eight-digit serial number may represent a pending application that is not yet eligible. Walmart’s Brand Portal marketing page also says an active USPTO registration is required for each brand. Those pages predate the June 2026 release note.

Practical rule: use the newest Walmart release note as the current public policy signal, but treat the fields and instructions shown inside your Brand Portal account as the operational submission requirements.

Pending and registered are different USPTO statuses

Question Pending application Registered trademark
USPTO identifier Application serial number Registration number; the record also retains its serial number
Legal process Still under review or moving through another pre-registration stage USPTO has issued a federal registration
Can the status fail or end? Yes. An application can be refused, opposed, or abandoned Yes. A registration can be canceled or expire if required maintenance is missed
Federal ® symbol No Yes, for the goods or services covered by the federal registration
Walmart Brand Portal Walmart’s June 5, 2026 release note says you may submit without waiting for registration, subject to review Supported by Walmart’s older and newer public guidance, subject to Walmart review

USPTO assigns a serial number after an application is filed. The application then moves through examination and, if approved, publication. Depending on the filing basis, additional steps may remain before registration. A filing receipt, publication, or notice of allowance is not a registration certificate.

Federal registration adds benefits that filing alone does not provide. USPTO lists a legal presumption of ownership and the right to use the mark, the ability to use the federal registration symbol, and other federal benefits. Registration still must be maintained, and the USPTO does not enforce a mark for its owner.

How to verify which status you actually have

  1. Open USPTO TSDR. Search using the application serial number or registration number.
  2. Read the current status text. Do not rely on a filing receipt, an attorney dashboard, or a marketplace label alone.
  3. Confirm the owner and mark. Compare the USPTO record with the brand and entity you intend to submit to Walmart.
  4. Check outstanding deadlines and documents. A live pending application can still require a response, statement of use, or another filing.
  5. Save the current status record. USPTO recommends monitoring a pending application at least every three to four months until it registers.

Do not describe a pending application as “registered.” Filing creates an application record, not a registration. Do not use the ® symbol until USPTO has issued the federal registration for the relevant goods or services.

If your trademark is pending

Start with the current Walmart Brand Portal flow rather than an older help page. Have the USPTO serial number and a consistent record of the mark and owner available. Walmart’s release note confirms the pending-application route, but it does not publish a complete document list, a review time, or an approval guarantee.

Continue monitoring USPTO separately. Walmart acceptance cannot cure an office action, prevent opposition, revive an abandoned application, or convert an intent-to-use application into a registration. If USPTO requires a response, deal with that deadline on its own terms.

For the Walmart-specific enrollment path, see Walmart Brand Portal with a pending trademark.

If your trademark is registered

Verify that the registration is live in TSDR and that the owner, mark, and covered goods or services are the records you intend to rely on. A registration number does not prove that every maintenance filing is current, so read the live status instead of relying on an old certificate.

A registered mark does not guarantee that Walmart will accept a brand, approve a claim, or change a listing. Walmart runs its own review and marketplace systems. Federal registration and Walmart platform privileges are separate layers.

What Brand Portal enrollment does not do

  • It does not register a trademark with USPTO.
  • It does not make a pending application legally equivalent to a registration.
  • It does not guarantee that the USPTO application will survive examination or opposition.
  • It does not guarantee Walmart approval, claim success, or a particular listing outcome.
  • It does not replace trademark monitoring, maintenance, or legal advice for a disputed mark.

Choose the next step from your actual status

Your situation Next step Avoid
No USPTO application Decide whether to file yourself or use a qualified trademark professional Buying a filing package that promises Walmart approval
Live pending application Verify TSDR, use Walmart’s current pending-application flow, and keep monitoring USPTO deadlines Calling the mark registered or ignoring USPTO correspondence
Abandoned or refused application Review the USPTO record and determine whether a response, petition, appeal, or new filing is available Submitting it to Walmart as a live pending application
Live registration Verify the registration and submit through Brand Portal Assuming an old certificate proves current status

Frequently asked questions

Can Walmart Brand Portal accept a pending trademark?

Yes. Walmart’s June 5, 2026 release note says a pending USPTO application can be used to register a brand in Brand Portal without waiting for final trademark approval. Walmart still reviews the submission.

Is a pending trademark the same as a registered trademark?

No. A pending trademark is an application still moving through the USPTO process. A registered trademark has completed the applicable registration steps and has been issued a federal registration.

Is a serial number the same as a registration number?

No. USPTO assigns a serial number to an application. A registration number is assigned when the trademark registers.

Can I use the ® symbol while my application is pending?

No. USPTO says the federal registration symbol may be used after federal registration and for the goods or services covered by that registration.

Does Walmart Brand Portal enrollment register my trademark?

No. Brand Portal enrollment is a Walmart platform process. Only USPTO can issue a United States federal trademark registration.

Why do some Walmart pages still say registration is required?

Those pages predate Walmart’s June 5, 2026 release note permitting pending applications. Because the documentation is not fully aligned, check the current Brand Portal form before submitting.

How do I check whether my trademark is pending or registered?

Use USPTO’s Trademark Status and Document Retrieval system and search by the application serial number or registration number. Read the current status and outstanding documents.

Can I submit an abandoned application as a pending trademark?

Do not treat an abandoned application as a live pending application. Check TSDR and the current Walmart form, then address the USPTO status before relying on it.
