Trademark Services for Walmart Brand Portal

Last reviewed August 25, 2026. USPTO fees, provider prices, package scopes and subscriptions can change; confirm every checkout total before paying.

The short version

Trademark services for Walmart Brand Portal should be compared by domicile, attorney coverage and total first-class cost—not by a promise of Walmart approval.

Short answer: a U.S.-domiciled applicant can file directly with the USPTO for a base fee of $350 for one class. A foreign-domiciled applicant must use a U.S.-licensed attorney. Walmart says a pending USPTO application can be submitted to Brand Portal without waiting for final registration, but enrollment remains subject to Walmart review.

Walmart accepts a pending application—but does not promise approval

Walmart Marketplace published a release note on June 5, 2026 stating that a brand with a pending USPTO trademark application can be registered in Brand Portal without waiting for final trademark approval. The same sentence says access follows review. It does not publish a guaranteed review time, acceptance standard, document list or outcome.

Some older Walmart guides still say an active registration and seven-digit registration number are required. Those pages predate the June 5, 2026 release note. XrdaGrid treats the newer release note as the current pending-application instruction and the older wording as a documentation conflict.

Read the separate guide to Walmart Brand Portal with a pending trademark before buying filing help. Filing creates a USPTO application; it does not create trademark registration, Walmart acceptance or a marketplace enforcement result.

Choose the legal route before comparing packages

Applicant USPTO representation rule Practical starting route
U.S.-domiciled individual or business May self-file; a U.S.-licensed attorney is optional Compare $350 direct filing with the cost and scope of attorney-assisted packages
Foreign-domiciled individual or business, including Canada Must be represented by a U.S.-licensed attorney for trademark submissions Use a provider that identifies the U.S. law firm or attorney responsible for the filing
Applicant with multiple classes, uncertain ownership, a weak mark or a prior conflict The domicile rule still applies; complexity changes the practical risk Get a scoped attorney engagement and a written quote for extra classes and substantive Office Actions

A form-preparation company is not a substitute for the U.S.-licensed attorney required for a foreign-domiciled applicant. Verify who signs and represents the application before paying.

Trademark services compared by first-class cost

The table normalizes one electronic Section 1 or Section 44 class using the current $350 USPTO base fee. The first-class floor excludes optional subscriptions, extra classes, $100 or $200 USPTO surcharges, intent-to-use filings due later, substantive Office Action responses, oppositions and appeals.

Route or provider Published service price One-class USPTO fee First-class floor Published scope Important limit
USPTO direct $0 $350 $350 Government filing system only No private search opinion or legal advice; foreign-domiciled applicants cannot self-file
Trademark Engine Basic $49 package; its process page also lists $100 for additional services/account setup $350 $499 Federal/common-law direct-match search, U.S.-licensed attorney review, filing by Swyft Legal Optional monitoring may renew; extra class is $450; custom goods/services may add $200 per class
Trademarkia Entry $499 $350 $849 Attorney-led pre-filing guidance, video consultation, U.S. law-firm support, search/risk guidance Watch Service Bundle is free for one month, then $29/month; insurance and other extras are separate
LegalZoom Premium Trademark Registration $899 $350 $1,249 Federal/common-law search, attorney advice, class selection, preparation and filing Included response scope is described as minor procedural Office Actions; monitoring auto-renews at $249/year after three months
Gerben IP $3,000 $350 $3,350 Federal/state/common-law search, opinion letter, up to 30-minute consultation, filing and tracking Office Action work is included only when it requires 30 minutes or less; additional work costs extra

“First-class floor” is a comparison device, not a quote. A class is a category of goods or services. A brand selling in several classes pays the government fee—and sometimes an additional provider fee—for each class.

What the $350 USPTO fee does not include

The base electronic application is $350 per class when it meets the base requirements. USPTO currently lists additional fees of $100 per class for insufficient information and $200 per class for using free-form goods/services wording instead of the Trademark ID Manual. Each additional 1,000-character group in a long free-form identification can add another $200 per affected class.

An intent-to-use application can require later payments: $150 per class for an amendment to allege use or statement of use, and $125 per class for an extension request. These future charges are not included in the comparison table because they do not apply to every filing.

See how XrdaGrid verifies prices for the normalization method and why optional and future fees are separated from the initial floor.

What to verify before you pay

  1. Confirm domicile. Foreign-domiciled applicants need a U.S.-licensed attorney; U.S.-domiciled applicants may self-file.
  2. Confirm the owner. The legal owner, entity type and domicile must be correct before filing. A provider should not guess.
  3. Count classes. Ask for the service fee and government fee for every class you actually need.
  4. Ask who is counsel. Get the name of the U.S. law firm or attorney of record and understand the limited-scope agreement.
  5. Define the search. A direct-hit database search is not the same as a legal clearance opinion covering federal, state and common-law risks.
  6. Price Office Actions. Ask what procedural and substantive responses are included and what triggers a new fee.
  7. Remove or calendar subscriptions. Monitoring trials may convert automatically. Record the renewal date and cancellation path.
  8. Do not buy a Walmart outcome. No provider can promise Brand Portal acceptance, USPTO registration or enforcement success.

Which route fits a Walmart Brand Portal goal?

Situation Most defensible route to evaluate Why
U.S.-domiciled, one class, clear ownership, comfortable with legal forms USPTO direct versus a low-cost attorney-reviewed package The price difference buys review and administration, not a different Walmart rule
Foreign-domiciled Walmart seller Provider or law firm that will be the U.S. attorney of record USPTO representation is mandatory; provider branding alone is not enough
Mark has possible conflicts or the brand is strategically important Broader clearance search and documented attorney opinion A cheap direct-hit search may not address related marks or common-law use
You only want Walmart access fast File accurately, then use Walmart’s current pending-application path A provider can speed its own preparation, but not USPTO examination or Walmart review

Frequently asked questions

Does Walmart Brand Portal accept a pending USPTO application?

Walmart’s June 5, 2026 release note says a pending USPTO trademark application can be used to register a brand in Brand Portal without waiting for final trademark approval. Walmart still reviews the submission, and the release note does not promise acceptance.

Which trademark service is cheapest for Walmart Brand Portal?

For an eligible U.S.-domiciled applicant, direct USPTO filing has the lowest initial floor at $350 for one class. Among the reviewed paid providers, Trademark Engine Basic has the lowest published first-class floor at $499 based on its $49 package and later $450 applicable-fee collection. Price alone does not establish the right fit.

Do foreign Walmart sellers need a U.S. trademark attorney?

A foreign-domiciled trademark applicant must use a U.S.-licensed attorney for USPTO trademark submissions. This includes Canadian applicants. The rule comes from the USPTO, not Walmart.

How much is the USPTO trademark application fee?

The base electronic fee is $350 per class for a Section 1 or Section 44 application that meets the base requirements. Extra classes and certain incomplete or custom goods-and-services descriptions add fees.

Can a trademark service guarantee Walmart Brand Portal approval?

No. A service may search, advise, prepare and file a USPTO application. Walmart independently reviews Brand Portal enrollment, while the USPTO independently examines the trademark application.

Are Office Action responses included in trademark packages?

Scope varies. LegalZoom publishes coverage for minor procedural Office Actions, while Gerben IP’s agreement includes responses requiring 30 minutes or less. Trademark Engine and Trademarkia should be asked for written scope and pricing for substantive responses before purchase.

Why can the checkout total exceed the advertised package price?

The advertised service price may exclude the $350-per-class government fee, extra classes, USPTO surcharges, intent-to-use filings, Office Action work and subscriptions that begin after a trial.
