Walmart Brand Portal Trademark Requirements

Jurisdiction: 🇺🇸 United States · Last reviewed: August 25, 2026

Walmart Brand Portal trademark requirements changed on June 5, 2026: Walmart now says a pending USPTO trademark application can support Brand Portal registration without waiting for final trademark approval. Walmart still reviews the Brand Portal submission, and its release note does not promise acceptance, timing, specific documents, or a particular outcome.

This guide separates that current marketplace update from older Walmart pages and from the separate USPTO trademark process.

Walmart Brand Portal trademark requirements today

Requirement Current position
Trademark status Walmart’s June 5, 2026 release note says a pending USPTO application may support Brand Portal registration, subject to Walmart review.
Trademark office Walmart’s public guidance points to USPTO marks. It says WIPO and EUIPO marks are not accepted for Brand Portal.
Applicant The rights owner applies. Walmart’s live Brand Portal says authorized third parties may be invited as account users.
Business location Walmart’s Overview lists the United States, United Kingdom, Canada, China, Hong Kong, India, South Korea, and Vietnam.
Account access Registered sellers can use Seller Center credentials and link the accounts.
Record consistency Walmart says the brand information submitted should match the trademark record.
Marketplace scope The public Brand Portal describes its services for the United States Walmart.com marketplace.

Important documentation lag: Walmart’s 2025 Brand Portal Overview, its March 2026 registration guide, and the current public Brand Portal homepage still use registered-mark or registration-number wording. The newer June 5, 2026 release note changes the pending-status answer, but it does not explain which field, identifier, or document the live pending-application path uses. Follow the current authenticated flow in your own account rather than a third-party upload checklist.

What Walmart changed—and what it did not

The current release note makes one narrow update: a pending USPTO application can be used to register a brand in Brand Portal without waiting for final trademark approval. It also preserves a review condition by saying the benefit follows once the submission is reviewed.

The note does not identify an accepted pending-application field, say that an eight-digit serial number should be entered into a specific box, list documents to upload, publish a review standard, give a review duration, or guarantee acceptance. XrdaGrid does not fill those gaps with guesses.

Application serial number vs registration number

Pending application

USPTO serial number

USPTO assigns a serial number after an application and filing fee are submitted. The application still faces examination and can receive an office action, be refused, or become abandoned.

Registered mark

Registration number and certificate

A registration number and registration certificate exist only if the mark registers. Brand Portal enrollment does not turn a pending application into a registration.

Use USPTO’s Trademark Status and Document Retrieval system to check an application or registration. Brand Portal status and USPTO status are separate records with separate consequences.

Who applies and which Walmart role you need

Situation Correct path
You own the trademark rights Apply for Brand Portal as the rights owner and provide information that matches the trademark record.
You represent the rights owner The current public Brand Portal says authorized third parties may be invited as account users. Its Overview says third-party sellers and brand-protection agencies are not accepted as applicants.
You sell the brand but do not own the trademark Use Seller Center to request acting brand owner or authorized reseller privileges rather than applying as the rights owner.
You need to report alleged infringement without an account Use Walmart’s public IP webform. That reporting route does not create Brand Portal access.

Prepare before you start the Brand Portal flow

  1. Confirm the USPTO record. Check whether you have a pending application or a registered mark and confirm its current status in TSDR.
  2. Confirm ownership. The applicant should be the rights owner; a seller without ownership uses the Seller Center role-request path.
  3. Check the location rule. Compare your business location with Walmart’s published country list.
  4. Make the records consistent. Align the brand name and business identity used in Walmart with the applicable trademark record.
  5. Use the current account flow. Sign in with Seller Center credentials where available and follow the fields shown in the authenticated Brand Portal.
  6. Keep the two reviews separate. Track Walmart’s application status in Brand Portal and the trademark application’s legal status in USPTO systems.

If the trademark owner is foreign-domiciled

This is a USPTO rule, not a Walmart rule: a foreign-domiciled trademark applicant or registrant must be represented before USPTO by a U.S.-licensed attorney. USPTO expressly includes Canadian filers. A person domiciled in the United States is not required to have an attorney, although USPTO recommends considering one.

What Brand Portal does not resolve

Platform boundary

No automatic acceptance

A qualifying trademark status does not guarantee Brand Portal approval, listing control, an enforcement decision, or any other Walmart outcome.

Legal boundary

No trademark registration

Brand Portal does not register a trademark, influence USPTO examination, cure an office action, or make registration more likely.

Catalog boundary

No reseller-contract enforcement

Walmart says it runs a unified catalog and does not intervene in authorized or unauthorized reseller arrangements or enforce private distribution contracts.

Frequently asked questions

Can I register a brand in Walmart Brand Portal with a pending trademark?

Walmart’s June 5, 2026 release note says a pending USPTO trademark application can support Brand Portal registration without waiting for final trademark approval. Walmart still reviews the submission.

Why do other Walmart pages still require a registered trademark?

Those public pages use older or undated registered-only wording. The June 2026 release note is the newer official statement for pending status, but it does not document the exact pending-application field or evidence path.

Should I enter my USPTO serial number or registration number?

Walmart’s release note does not say which identifier the pending-application workflow accepts. Use the current authenticated Brand Portal flow. Do not treat an application serial number as proof that the mark is registered.

Does Walmart accept a WIPO or EUIPO trademark?

Walmart’s public Brand Portal guidance says it currently accepts USPTO trademarks, not WIPO or EUIPO marks.

Can a seller or agency apply instead of the rights owner?

Walmart’s public guidance says the rights owner applies. Authorized third parties may be invited as account users, while sellers that do not own the mark use Seller Center’s acting-brand-owner or authorized-reseller process.

Does Brand Portal approval mean the trademark will register?

No. Brand Portal is a Walmart platform program. USPTO examination and registration remain separate.

Limitations

This guide covers Walmart’s United States marketplace and the related U.S. federal trademark layer as of August 25, 2026. Walmart’s public pages are not fully synchronized with its June 2026 pending-application release note. The release note does not publish the pending-flow fields, document list, review standard, timing, or approval criteria, so this guide does not invent them. This is general information, not legal advice. XrdaGrid does not guarantee Brand Portal acceptance, USPTO registration, an enforcement decision, or a listing outcome.
